Advisory committee on Landscape Design and Management

Administrative Resolution Number 79

WHEREAS, Article 3, of the Bylaws of the Condominium assigns to  the Board of  Directors “all of the powers and duties necessary for the administration of  the affairs of the Unit Owners Association and may do all such acts and things as are not by the Condominium Act or the Condominium Instruments required to be exercised and done by the Association”, and

      WHEREAS,  Article 4, Section 4.4 of the Bylaws grants the President of the Association the power to "appoint committees from among the Unit Owners from time to time as the President may, at his discretion, decide is appropriate to assist in the conduct of the affairs of the Association," and,

      WHEREAS, to better carry out such duties, the Board deems it necessary to establish terms of reference for a committee to advise and assist the Board with respect to communication policies and programs for the Association.

      NOW, THEREFORE, BE IT RESOLVED THAT the following Terms of Reference be adopted for the ad hoc advisory committee on Landscape Design and Management:

OBJECTIVE: To continue the review of Lawn Care practices at Montebello in order to provide  the Board of Directors by September 2006 a plan and recommendations for practical landscape improvements and changes in practices that will move toward making our total lawn area pesticide- and herbicide-free in the future.  Further, to review practices and advice for management and care of Montebello’s wooded areas and present recommendations for objectives in woods management, plans to achieve those objectives, and cost estimates for carrying out those plans.

GUIDANCE:

1. Consider that a Montebello objective is to conduct a lawn and woods care program that is of minimal risk for Montebello residents and their pets, such that our natural amenities are preserved, and that is attractive for residents and future residents.                                        

2. To benefit from the experience of others, evaluate changed practices in the use of the lawn care chemicals at other communities and alternative treatments readily available.

3. Advise on the feasibility of moving toward a totally pesticide/herbicide-free environment at Montebello.

4. Establish selection criteria and advise on selection of experts who will evaluate the current design and practices as to the safety, cost and effectiveness of chemical treatments of lawns, gardens, and forested areas.  Consider presenting an active model program in being, should one be found, and its adaptability to Montebello.

5. Establish selection criteria and advise on selection of a consultant who will (a) prepare lawn design/care plans and budgets, (b) discuss those plans and budgets with the community, and (c) prepare an implementation plan that can be used in the scope of work to be used in bidding for the lawn maintenance contract for 2007 and beyond.

6. Based on inspections, advice, and recommendations of one or more consultants, (a) prepare a woods management plan and budget, (b) discuss the plan and budget with the community, and (c) recommend an implementation plan that can be used to prepare a scope of work for a contractor in 2007 and beyond.

7. Based on the consultants work and community input, recommend a plan, budget, and estimate of long term savings to the Board of Directors. Project the potential benefits and costs, and risks of those recommendations.

8. Committee will update the Board of Directors at the regularly scheduled monthly Board meetings.

9. The ad hoc committee will end on September 30, 2006.

10. The President of the Board shall appointment a Board liaison to the advisory committee.

11. Membership on the advisory committee shall include a representative from the Operation’s Committee Landscape Working Group.
